2. Service Agreements
2.1 Photography Services
Aperture Vista Studios provides professional photography services, including portrait, landscape, wedding, event, real estate, and product photography. Specific details of the services provided, including pricing, duration, and deliverables, will be outlined in a separate service agreement or contract provided to you before the commencement of any photography session.
2.2 Booking and Scheduling
To book a photography session with Aperture Vista Studios, you must contact us via email, phone, or through the contact form on our website. Session dates and times are subject to availability and will be confirmed upon mutual agreement. A deposit may be required to secure your booking.
2.3 Cancellations and Rescheduling
Cancellations and rescheduling requests must be made at least 72 hours prior to the scheduled session date. Cancellations made within 72 hours of the session may result in forfeiture of the deposit. Rescheduling is subject to availability. Aperture Vista Studios reserves the right to cancel or reschedule a session due to unforeseen circumstances, such as inclement weather or photographer illness. In such cases, a full refund of any deposit paid will be offered, or the session will be rescheduled at no additional cost.
2.4 Session Conduct
Clients are expected to conduct themselves in a respectful and cooperative manner during photography sessions. Aperture Vista Studios reserves the right to terminate a session if a client’s behavior is deemed inappropriate or disruptive. In such cases, no refund will be provided.
3. Payment Terms
3.1 Pricing and Payment
The price for photography services will be clearly stated in the service agreement or contract. Payment is due according to the terms outlined in the agreement. We accept various forms of payment, including credit cards, debit cards, and electronic transfers. All prices are listed in US Dollars (USD) and are subject to applicable taxes.
3.2 Deposits
A non-refundable deposit may be required to secure your booking. The deposit amount will be specified in the service agreement and will be credited towards the total cost of the photography services.
3.3 Late Payment Fees
If payment is not received within the agreed-upon timeframe, a late payment fee may be applied. The late payment fee will be outlined in the service agreement.
4. Copyright Information
4.1 Ownership of Copyright
Aperture Vista Studios retains all copyright to the photographs taken during a photography session, unless otherwise specified in a written agreement. Clients receive a limited license to use the photographs for personal, non-commercial purposes, such as printing and sharing on social media. Commercial use of the photographs is prohibited without our express written consent.
4.2 Usage Rights
Clients may not alter, modify, or manipulate the photographs in any way without our permission. Aperture Vista Studios reserves the right to use the photographs for promotional purposes, including on our website, social media, and in marketing materials, unless otherwise agreed upon in writing.
5. Limitation of Liability
5.1 Disclaimer
Aperture Vista Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of our website or photography services, even if we have been advised of the possibility of such damages. Our liability is limited to the amount paid by you for the photography services.
5.2 Force Majeure
Aperture Vista Studios shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions or a service agreement if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, strikes, or governmental regulations.
6. Governing Law
6.1 Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Seattle, Washington.
